Trail Forge Adventures - Terms and Conditions

Welcome to Trail Forge Adventures! By using our website and services, you agree to the following Terms and Conditions. Please read them carefully before creating an account or making a purchase.

  1. Your Account
    • You must be at least 18 years old to create an account.
    • You are responsible for maintaining the confidentiality of your login details.
    • You are responsible for all activity that occurs under your account.
    • You agree to provide accurate and complete information when creating your account and to keep it up to date.
  2. Buying and Selling
    • Trail Forge Adventures provides a platform for users to buy and sell trail guides and adventures.
    • We do not own or control the content listed by users.
    • When you purchase an adventure, you receive access to the adventure guide content, including any associated GPX files and a downloadable PDF guide.
    • All purchases are final once you have downloaded any GPX files or the PDF guide associated with the adventure.
    • By completing a purchase, you agree that access to digital content is granted immediately and that downloading content constitutes use of the product.
  3. License and Intellectual Property
    • When you purchase an adventure, you are granted a personal, non-commercial, non-transferable license to access and use the content for your own private use.
    • You may not copy, redistribute, share, resell, sublicense, or make available any purchased content — including GPX files, PDF guides, and adventure data — to any third party.
    • You may not use purchased content to create derivative works or competing products.
    • All intellectual property rights in adventure content remain with the original seller or content creator.
    • Trail Forge Adventures retains all rights to the platform, branding, software, and design.
  4. Seller Obligations
    • Sellers are responsible for the accuracy and quality of the adventure content they list.
    • Sellers must ensure they have the right to sell and distribute the content they upload, including GPX data and trail information.
    • Sellers must not list content that infringes on others' intellectual property rights.
    • Sellers acknowledge that trail and environmental conditions change over time and should make reasonable efforts to keep their content current.
    • Sellers are responsible for complying with all applicable laws and regulations related to their content and business activities.
  5. User Content
    • You are responsible for any content you upload, including adventure guides, reviews, and ratings.
    • You grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary to operate the marketplace.
    • Reviews and ratings must reflect your genuine experience and must not be misleading, defamatory, or abusive.
  6. Prohibited Activities

    You agree not to:

    • Violate any applicable laws or regulations.
    • Upload harmful, fraudulent, or misleading content.
    • Infringe on others' intellectual property rights.
    • Share, redistribute, or resell purchased adventure content.
    • Use automated tools to scrape, download, or copy content from the platform.
    • Attempt to gain unauthorized access to other users' accounts or platform systems.
    • Interfere with or disrupt the operation of the platform.
  7. Payments
    • All transactions are processed through secure third-party payment providers.
    • Prices are displayed in US dollars and include any applicable platform fees.
    • You agree to pay all charges incurred through your account at the prices in effect at the time of purchase.
  8. Refunds
    • Refunds may be requested by contacting our support team.
    • Refunds are not available if you have downloaded any GPX files or the PDF guide associated with the purchased adventure.
    • If you have not downloaded any content, a full refund may be issued at our discretion.
    • When a refund is issued, your access to the adventure and all associated content will be revoked immediately.
    • Refunds are processed through the original payment method and may take 5-10 business days to appear on your statement.
  9. Outdoor Activity Risks and Safety
    • Adventure guides are informational resources only and are not a substitute for proper planning, equipment, training, or judgment.
    • Trail conditions, weather, terrain, and access may change at any time. Content may not reflect current conditions.
    • You are solely responsible for assessing the risks of any outdoor activity and for your own safety.
    • You should always carry appropriate safety equipment, check current conditions, and inform others of your plans before undertaking any outdoor activity.
    • Trail Forge Adventures and its sellers make no guarantees regarding the safety, accuracy, or current condition of any trail, route, campsite, or point of interest described in adventure content.
  10. Content Accuracy and Staleness
    • Adventure content, including trail routes, GPS coordinates, campsite information, and points of interest, reflects conditions at the time the content was created or last updated.
    • We do not guarantee that any content is accurate, complete, or up to date.
    • You should independently verify trail conditions, road access, permit requirements, and other critical information before relying on any adventure guide.
  11. Disclaimers and Limitation of Liability
    • The platform and all content are provided “as is” and “as available” without warranties of any kind, whether express or implied.
    • We do not warrant that the platform will be uninterrupted, secure, or error-free.
    • To the maximum extent permitted by law, Trail Forge Adventures shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or any adventure content.
    • Our total liability to you for any claims arising from these terms or your use of the platform shall not exceed the amount you paid to Trail Forge Adventures in the 12 months preceding the claim.

  12. Indemnification
    • You agree to indemnify, defend, and hold harmless Trail Forge Adventures, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these terms, or your violation of any third-party rights.
  13. Dispute Resolution
    • Any disputes between buyers and sellers should first be directed to our support team, who will make reasonable efforts to facilitate a resolution.
    • Any disputes arising from these terms that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
    • You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
  14. Third-Party Services
    • The platform relies on third-party services for payment processing, authentication, file storage, and other functionality.
    • We are not responsible for the availability, accuracy, or performance of third-party services.
    • Your use of third-party services is subject to their respective terms and privacy policies.
  15. Termination
    • We may suspend or terminate your account if you violate these terms.
    • Upon termination, your right to access the platform and any purchased content may be revoked.
    • Sections relating to intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.
  16. Changes to These Terms
    • We may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated “Last Updated” date.
    • Continued use of the platform after changes are posted constitutes your acceptance of the revised terms.
